By accessing or using Desert Labs, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the platform. We may update these terms from time to time, and your continued use constitutes acceptance of any changes.
2. Description of Service
Desert Labs is a cloud-based customer relationship management (CRM) platform designed for service businesses. The platform provides client management, invoicing, appointment scheduling, payment processing, and a branded client portal. Features may vary by subscription plan.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to notify us immediately of any unauthorized use.
4. Acceptable Use
You agree to use Desert Labs only for lawful purposes and in accordance with these terms. You may not use the platform to transmit harmful, fraudulent, or offensive content, to interfere with the platform's operation, or to violate any applicable laws or regulations.
5. Payment Terms
Paid subscriptions are billed in advance on a monthly or annual basis. Payments are processed securely through Stripe. You agree to provide valid payment information and authorize us to charge the applicable fees. Refunds are handled in accordance with our refund policy.
6. Intellectual Property
All content, features, and functionality of the Desert Labs platform — including text, graphics, logos, and software — are the property of Desert Labs and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of the data you upload to the platform.
7. Limitation of Liability
To the fullest extent permitted by law, Desert Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
8. Termination
You may cancel your account at any time through your account settings. We reserve the right to suspend or terminate your account if you violate these terms. Upon termination, your right to use the platform ceases immediately, and we may delete your data after a reasonable retention period.
9. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify you of significant changes via email or through a notice on the platform. Your continued use after changes are posted constitutes acceptance of the revised terms.
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.
